Fancy Travelling to all 201 Countries, Avoiding Air Travel? Graham Hughes did.

An adventurer called Graham Hughes has become the first Brit to travel to all 201 countries without stepping foot on an airplane. He reached his final destination, South Sudan, last week, which wasn?t even a country when he began his trip.
Mr Hughes has entered the Guinness Book of Records for his journey, which began on New Year?s Day back in 2009. His trip cost approximately ?10 per day, and he managed to get around by train, boat?and bus, occasionally hitching rides on cargo ships and canoes?too.
Among his highlights, Mr Hughes listed;
????????? Dancing with tribes in the jungle in Papua New Guinea.
????????? Observing one of the penultimate space shuttle launches in Cape Canaveral.
????????? Swimming with Jellyfish in the Pacific Ocean.
During his trip, the intrepid adventurer was actually arrested twice, firstly in Cape Verde after hitching a lift with a fishing canoe, and again in the Democratic Republic of Congo where he was jailed for six days accused of being a spy!
Now that Mr Hughes has completed his adventure, he still refuses to travel by air, and instead is going to travel home by bus and boat, and should arrive back to his home in Liverpool by Christmas.
His trip raised funds for the charity Water Aid, for more information on Mr Hughes and his trip, you can visit his website; The Odyssey Expedition.

Big Tobacco uses trade pacts to thwart new laws

A pack of Marlboro Menthol cigarettes intended for sale in Australia. As of Dec. 1, all cigarettes sold in the country must be sold in plain packaging with graphic warnings covering 75 percent of the front and 90 percent of the back of the pack under a groundbreaking law.

By Myron LevinFairWarning

As countries around the world ramp up their campaigns against smoking with tough restrictions on tobacco advertising, the industry is fighting back by?invoking international trade agreements to thwart the most stringent rules.

A key battlefront is Australia, which is trying to repel a legal assault on its groundbreaking law requiring cigarettes to be sold in plain packs without distinctive brand logos or colors. Contesting the law, which takes effect Dec. 1, are the top multinational cigarette makers and three countries ? Ukraine, Honduras and Dominican Republic ? whose legal fees are being paid by the industry.

The dispute underlines broader concerns about trade provisions that enable foreign companies to challenge national health, labor and environmental standards. Once a country ratifies a trade agreement, its terms supersede domestic laws. If a country?s regulations are found to impose unreasonable restrictions on trade, it must amend the rules or compensate the nation or foreign corporation that brought the complaint.

In the case of Australia?s plain packaging law, the tobacco industry and its allies are challenging the measure as a violation of intellectual property rights under trade agreements the nation signed years ago.

Public health advocates fear the legal attack will deter other countries from passing strong measures to combat the public health burdens of smoking. The ?cost of defending this case, and the risk of being held liable, would intimidate all but the most wealthy, sophisticated countries into inaction,? said Matthew L. Myers, president of the Campaign for Tobacco-Free Kids in Washington D.C.

The advocates also say countries should be free to decide how best to protect public health, without being second-guessed by unelected trade panels. Moreover, they argue, tobacco products, which kill when used as intended, should not be afforded the same trade protections as other goods and services.

Worldwide, nearly 6 million people a year die of smoking-related causes, according to the World Health Organization, which says the toll could top 8 million by 2030. With fewer people lighting up in wealthy nations, nearly 80 percent of the world?s 1 billion smokers live in low- and middle-income countries.

Marlboro, the world's top-selling brand, is shown packaged under labeling laws of, clockwise from upper left, the U.S., Egypt, Djibouti, Hungary.

Countries have been emboldened to pass more stringent measures by the Framework Convention on Tobacco Control. In effect since 2005, the treaty has committed about 175 nations to pursue such measures as higher cigarette taxes, public smoking bans, prohibitions on tobacco advertising, and graphic warning labels with grisly images such as diseased lungs and rotting teeth (The U.S. has signed the treaty, but the Senate has not ratified it. The U.S. Food and Drug Administration has ordered graphic warnings for cigarette packs, but an industry court challenge on 1st Amendment grounds has stalled the rule.)

Cigarette makers say they acknowledge the hazards and the need for regulations. ?We actually support the vast majority of them,? said Peter Nixon, vice president of communications for Philip Morris International, which has its headquarters in New York, its operations center in Switzerland, and is the biggest multinational cigarette maker with 16 percent of global sales.

Bans on cigarette ads spread
But the industry has watched with growing concern as more than 35 countries have adopted total or near-total bans on cigarette advertising. Its big profits depend on consumer recognition of its brands. Yet in many countries, the once-ubiquitous logos and imagery are receding, leaving the cigarette pack as a last refuge against invisibility.

Now the pack, too, is under attack. Along with plain packaging laws such as Australia?s, countries are weighing retail display bans that keep cigarette packs out of view of consumers, and laws requiring graphic health warnings so large that there is barely any room for trademarks. Tobacco companies contend that countries enforcing such rules are effectively confiscating their intellectual property and must pay damages.

The industry also claims that measures like plain packaging are counterproductive. ?We see no evidence ? none at all ? that this will be effective in reducing smoking,? Nixon of Philip Morris International said in an interview. In fact, he said, generic packaging likely will increase sales of cheap, untaxed counterfeit smokes, thus increasing consumption.

Todd Rosenberg / Philip Morris

Louis Camilleri, chairman and CEO of Philip Morris International.

Louis C. Camilleri, chairman and CEO of Philip Morris International, drew a line in the sand in remarks to Wall Street analysts in November, 2010. The company would use ?all necessary resources and?where necessary litigation, to actively challenge unreasonable regulatory proposals,?? Camilleri said, specifically mentioning plain packaging and display bans.

Up to now, tobacco-related trade disputes have mostly involved quotas or tariffs meant to protect domestic producers from foreign competition.??

The key issue now, though, isn?t traditional trade barriers, but whether health regulations unduly restrict the movement of goods. In challenging anti-smoking rules, the industry has drawn on global treaties, such as the 1994 pact known as TRIPS (the Agreement on Trade Related Aspects of International Property Rights), that include broad protections for intellectual property and foreign investment.

In the hands of aggressive corporations, such long-standing provisions have become ??the ticking time bomb for this century as governments tackle problems like tobacco, the environment, obesity, access to essential medicines,? said Myers of the Campaign for Tobacco Free Kids.

Two recent legal decisions showed that such cases are no slam dunk for the industry.? In September, a court in Oslo, Norway, rejected a lawsuit by Philip Morris Norway AS that challenged the country?s retail display ban. The company had claimed that in enforcing the ban, Norway had violated the European Economic Agreement by failing to adopt the least trade-restrictive measures to achieve its public health goals.

The court, siding with Norway?s government, found that other measures would not be as effective in insuring that ?as few as possible youngsters begin to smoke.??

Australia also triumphed in the first round of its legal defense of plain packaging. Rejecting a lawsuit by the four top global companies -- Japan Tobacco Inc. and Imperial Tobacco, along with British American and Philip Morris International ? Australia?s High Court upheld the law as legal and constitutional.?

The law requires that all cigarettes be sold in drab olive-brown packs, with pictorial warnings covering 75 percent of the front and 90 percent of the back.

The goal is to reduce ?the attractiveness and appeal of tobacco products to consumers, particularly young people,? a spokeswoman for Australia?s Department of Health and Ageing said in an email to FairWarning.

But two major challenges remain.

Australia law challenged under trade pacts
In one, Philip Morris Asia has accused Australia of violating a 1993 bilateral trade pact between Hong Kong and Australia. Such agreements, known as investor-state treaties, allow a foreign investor by itself to bring an arbitration claim for damages against a country.

The case is before an arbitration panel of the U.N. Commission on International Trade Law.

In the other, Ukraine, Honduras and the Dominican Republic earlier this year brought their challenges before the World Trade Organization.

The complaint in March by Ukraine was a striking paradox. Its trade ministry filed the challenge within hours of Ukraine?s president signing a ban on tobacco advertising, and its parliament voting to ban public smoking ? revolutionary moves in chain-smoking Eastern Europe. Trade officials took the action despite Ukraine having no tobacco exports to Australia, and therefore no apparent financial interest in its anti-smoking policies.

But prodded by the tobacco industry, the trade ministry branded the plain packaging law as a violation of intellectual property rights that Australia was bound to protect.

Honduras and the Dominican Republic soon joined the attack on Australia, filing similar complaints with the WTO.

Cigarette makers are paying for heavyweight lawyers to represent the three countries.?

As company representatives have told FairWarning, Philip Morris International is paying the firm of Sidley Austin to represent the Dominican Republic, while British American is picking up legal expenses for Ukraine and Honduras.?

?We are happy to support countries who, like us, feel plain packaging could adversely affect trade,? said British American spokesman Jem Maidment.?

It?s not unusual in trade disputes for corporations to give legal assistance to governments with mutual interests. In this case, however, the three countries appear to have little, if any, direct stake in Australia?s tobacco control policies.

While tobacco exports from Ukraine to Australia are nonexistent, exports from Honduras and Dominican Republic in the past three years have averaged $60,000 (U.S.) and $806,000, respectively, according to figures from Australia?s Department of Foreign Affairs and Trade.

Responding in April to an inquiry from Ukrainian journalists, the country?s Ministry of Economic Development and Trade said it had ?a policy of supporting Ukrainian producers and protecting their interests in the internal and external markets.? In this case, the ministry said, it had ?received concerns? about Australia?s law from the Ukrainian Association of Tobacco Producers, made up of the top tobacco multinationals, and from the Union of Wholesalers and Producers of Alcohol and Tobacco Association.?

Konstantin Krasovksy, a tobacco control official in Ukraine?s Ministry of Health, told FairWarning the countries had allowed themselves to be used. ?Honduras, Dominican Republic and Ukraine agreed to be a prostitute,? he said.

Honduran officials, in an April press release, said Australia?s law ??contravenes?? its trade obligations. It noted that the tobacco industry ?employs several hundred thousand people directly and indirectly throughout the supply chain in Honduras.?

The Dominican Republic, a major cigar exporter, also said plain packaging ?will have a significant impact on our economy.?? In a written statement to FairWarning, Katrina Naut, director general for foreign trade with the country?s Ministry of Industry and Commerce, said that if other countries join Australia in adopting plain packaging, it will lead to falling prices for name-brand tobacco products and ?an increase ? rather than a decrease ? in consumption and illicit trade.??

Uruquay vs. Philip Morris
Among supporters of Australia, none is more vociferous than the government of Uruguay. It recently told the WTO?s Dispute Settlement Body that the global trading system ?should not force its Members to allow that a product that kills its citizens in unacceptable and alarming proportions continues to be sold wrapped as candy to attract new victims.?

Uruguay?s stance reflects its own high-stakes battle with Philip Morris.

The tobacco giant has challenged Uruguay?s requirement of graphic warnings on 80 percent of cigarette packs. Philip Morris is also fighting a rule that limits cigarette marketers to a single style per brand, making it illegal to sell Marlboro Gold and Green along with Marlboro Red.

The challenge by Swiss units of Philip Morris cites a 1991 bilateral treaty between Switzerland and Uruguay. Since filing the complaint in 2010, the tobacco company has also closed its only cigarette factory in Uruguay.

The regulations ?are extreme, have not been proven to be effective, have seriously harmed the company?s investments in Uruguay,? according to a statement by Philip Morris International.

Uruguay, with a population of less than 3.5 million and an annual gross domestic product of about $50 billion, seems a poor match for the tobacco giant, which had sales of $77 billion in 2011.

Amid reports that government officials were seeking a face-saving settlement, Bloomberg Philanthropies announced in late 2010 that it would fund the legal defense of Uruguay?s anti-smoking laws. New York Mayor and businessman Michael R. Bloomberg, an ardent tobacco foe, affirmed the support of his namesake charity in a call to Uruguayan President Jose Mujica.

Advocates fear other countries may have a harder time standing their ground. ?Bloomberg has been very generous, but his resources are not unlimited and he can?t pay to defend every tobacco regulation in every country,? said Chris Bostic, deputy director for policy for the group Action on Smoking and Health.

The Uruguay case could be pivotal, said Dr. Eduardo Bianco, president of the Tobacco Epidemic Research Centre ?in Uruguay. ?If they (Philip Morris International) succeed with Uruguay they would send a clear message to the rest of the developing countries: ?take care about us, you can be next.?"

    2013 Honda Civic

In case you've forgotten, the 2012 Honda Civic landed with a big thud. And rightfully so. The car was a cheap version of its former self and lacked the personality and quality to compete within its segment.

Fortunately for Honda, the brand has some cache. As Honda executives emphatically reminded the audience at Honda's press conference during the L.A. Auto Show, despite the poor reviews, the Civic remains the top-selling car in its category. Even so, Honda acted fast to rectify Civic Gate 2012. For 2013 the carmaker rolled out a heavily refreshed Civic to appease the critics.

The new Civic's sheetmetal was almost entirely overhauled with a new grille and mouth, a new sculpted hood, new wheels, a new taillight design, new trunk lid, and new bumper. On the interior, Honda says it updated the Civic's instrument panel, added soft touch materials to the dash and doors, improved functionality on its information screen, enhanced ride quality and cab quietness, and added Bluetooth, Pandora, SMS texting, and a backup camera standard. In terms of safety, the 2013 Civic will have side curtain airbag sensors and available forward collision warning and lane departure warning. Honda did all of this and more while only having to raise the price of the new 2013 Civic by $160 to $18,965.

It's an impressive upgrade that was accomplished in lighting speed for the auto industry, but you have to wonder how those 2012 Civic owners will feel when they see how much Honda was holding back.

NASA: Enough ice on Mercury to cover D.C.

New evidence suggests Mercury's north polar region contains large deposits of ice (NASA/Johns Hopkins Universi??NASA's MESSENGER spacecraft has discovered evidence that the planet Mercury has enough ice on its surface that it could encase Washington, DC in a block two and a half miles deep.

"For more than 20 years the jury has been deliberating on whether the planet closest to the Sun hosts abundant water ice in its permanently shadowed polar regions," writes Sean Solomon of the Columbia University's Lamont-Doherty Earth Observatory, principal investigator of the MESSENGER mission. "MESSENGER has now supplied a unanimous affirmative verdict."

"These reflectance anomalies are concentrated on poleward-facing slopes and are spatially collocated with areas of high radar backscatter postulated to be the result of near-surface water ice," Gregory Neumann of the NASA Goddard Flight Center writes in the paper. "Correlation of observed reflectance with modeled temperatures indicates that the optically bright regions are consistent with surface water ice."

The study results were published Wednesday in Science magazine, which explains in its summary, "The buried layer must be nearly pure water ice. The upper layer contains less than 25 wt.% water-equivalent hydrogen. The total mass of water at Mercury's poles is inferred to be 2 ? 1016 to 1018 g and is consistent with delivery by comets or volatile-rich asteroids."

Radar imaging of Mercury has long suggested that there could be large deposits on the planet's surface, with reports dating back to 1991. But today's report presents harder evidence backing up that theory.

MESSENGER has fired more than 10 million laser imaging pulses at Mercury's surface since arriving in orbit in 2011. Feedback from those pulses have helped NASA in its quest to verify whether ice is present in Mercury's poles, which are largely shielded from exposure to the sun's rays.

When was your baby shower? - Adoption.com Forums

I needed absolutely everything, too. I'm a first time mom so I had nothing. I didn't want a shower or even want to buy a lot of things myself because adoption is so uncertain until it actually happens.

When I got "the call" it was also 2 weeks before baby was born. I still didn't buy anything or allow a shower. I learned from people here on a.com that very little is actually needed right away. The hospital sweetpea was born in provided a lot of stuff. If you have a car seat you're okay. When Sweetpea left the hospital, my mom went and bought some clothes, diapers, bottles etc.

After TPR, ICPC, and all that fun stuff we were able to come home. Then someone held a "Meet Sweetpea" party for friends and family.

As a previous poster said, if I had to come home without Sweetpea it would have been really hard to look at baby things and wonder what to do with them.

Having a shower after baby is home and TPR has happened is the way to go IMHO. It not only protects you in case the adoption doesn't happen it also gives friends and family a chance to meet baby.

Wall Street increasingly bullish about 2013

    9 hrs.

Even the bears are bullish for 2013, a year in which virtually every Wall Street expert believes the market will overcome its many headwinds and post a positive year.

While retail investors have been preoccupied with worries over fiscal armageddon, an election that is now past and a global economy nearing stall speed, strategists have been busy with projections that see sizeable stock gains.

Their reasons: A U.S. economy that is on the mend due to the nascent housing recovery and an expected surge in earnings, more cheap money from the Federal Reserve, and a general feeling that none of the various-worst scenarios out there will come to fruition.

"At first blush, it seemed like an inopportune time to commit to a year-ahead target and outlook, what with so many global uncertainties in our path," said Sam Stovall, chief equity strategist at Standard & Poor's/Capital IQ. "But most of these uncertainties have been with us for quite some time, and are now regarded by many as annoyances to resolve rather than obstacles to fear."?

The firm is near the high end of the pack, projecting a 1,550 close for the S&P 500 by the end of next year, a nearly 11 percent rise from current levels.

Obstacles such as the "fiscal cliff" of automatic spending cuts and tax increases that will take effect if Washington fails to reach deficit-reduction targets worry Stovall, but he believes that issue, as well as the debt crisis and recession in Europe, won't stop stocks.

"We believe the manner in which these headwinds are resolved could result in an explosive rally rather than just a sigh of relief," he said. "Yet, handled inappropriately, these could end up causing a low flying economy to crash."

While not predicting an outright crash, Adam Parker, chief market strategist at Morgan Stanley, had through the year been predicting the market to swoon lower from a lackluster 2011.

But his projection of an 1,167 for the S&P 500 has virtually no chance of happening absent a colossal stock market event.

For 2013, Parker has changed his tune.

"We wish we didn?t have to set a year-end target. Having had a very accurate one in 2011 and a pretty bad one in 2012, we are living proof that there is a negative asymmetry," he said in the firm's 2013 outlook. "We felt little joy in 2011 and lots of pain in 2012 related to the target, and find few credible investors really care where we think the market is going to be on a particular day one year in the future.

"What they more often care about is the logic and thought process, and the empirical evidence that support it."

Parker sees a modest 2013 rally driven by mega-cap dividend stocks and a rebound in China, as well as a broader picture of rising earnings.

His S&P 500 call is for "low- to mid-single-digit upside" with the S&P 500 closing at 1,434.

"We have been cautious on US equities for much of the last two years," he wrote in his analysis. "Our concerns around U..S deficit/debt and the obvious borrowing from the future that occurs from unconventional policy, the European sovereign crisis, and slower growth in emerging markets generally remain, but the acuteness of these issues appears for now to be less sharp."

While that's not exactly wide-eyed bullishness, it is enough to make contrarians think that sentiment could be getting a little overheated on Wall Street.?

"The reasons we're skeptical of it being able to break to new highs is, first of all, everybody's bullish," said Walter Zimmerman, senior technical analyst at United-ICAP in Jersey City, N.J. "The readings are consistent with those at a major top."

Still, even someone normally as bearish as Zimmerman thinks the near-term direction is higher, though he doesn't see a sustained rally through next year.

That's not the case at Canaccord Genuity, which has one of the most bullish calls yet at 1,650, with only Piper Jaffray's 1,700 higher thus far.

"History, global monetary policy, and the fundamental sweet spot of U.S. economic data argue strongly for better performance as we move...into next year," Canaccord's Tony Dwyer and Michael Welch said.

Deutsche Bank, meanwhile, remains bullish with a 1,500 call. The firm is "encouraged by the continued intention of central banks to maintain accommodative policy" and believes that "given current market pricing, equities continue to offer the best risk-adjusted return compared to other asset classes."

And Bank of America Merrill Lynch, whose 1,450 for 2012 remains very much in play, believes the S&P 500 will close out the coming year at a 10 percent rise from its projected finish for the current year.

"We are cautious on the near-term outlook for US equities, but we remain constructive on the medium to longer term outlook," Savita Subramanian, equity and quant strategist at BofA, said in a note. "Given the S&P 500's attractive valuation and weak investor sentiment, we expect positive earnings growth to drive the market to 1,600 by the end of 2013."

Android Juggernaut Slowed by iPhone 5, Returning Apple to Dominance

**Editor's note: Please click here for our list of October's hottest selling smartphones to see the showdown between the iPhone and its closest Android competitors..**

Google's Android operating system, estimated to control more than half of market share in many recent studies, will once again have to take a backseat to Apple and its iconic iPhone, at least for now.

Numbers from consumer researcher Kantar Worldpanel ComTech show that enormous sales of the iPhone 5 ? which went on sale in late September ? were enough to move the Apple mobile operating system (iOS) back into first place in the U.S. Its market share was 48.1 percent, compared to Android's 46.7 percent, in the 12-week period ending Oct. 28?? not bad when you consider that there's only one phone that runs on iOS and dozens, if not more, that use Android.?That leaves only 5 percent for BlackBerry, Windows Phone and others struggling to compete with the two most dominant operating systems in America ? and on the planet.

?The last time we saw iOS overtake Android in the U.S. was when the iPhone 4S was released and Apple managed to retain its lead for three consecutive periods," said Dominic Sunnebo, global consumer insight director at Kantar Worldpanel ComTech. "This time we predict that Apple will beat its previous high of 49.3 percent and achieve its highest ever share of the U.S. smartphone market within the next two periods."

Kantar Worldpanel says Android is still king in Europe, accounting for nearly 74 percent of sales in Germany and almost 82 percent in Spain during the period. Apple, however, is making gains in four of the five major European countries, with a particularly strong performance in Britain, where it holds almost a 33 percent share.

The researcher says the majority (62 percent) of iPhone 5 sales in the U.S. have been to existing owners wanting to upgrade. Apple also has benefited from Android users making the switch (13 percent).

Finding Your Balance from A to Chi: A Must-Have in Any Relationship

College is supposed to be the best four years of your life, so why not love every minute of it?

Have you ever thought about the one non-negotiable trait you seek in a partner? While many times people say ?attractive? or ?good sense of humor? when talking about their ideal boyfriend or girlfriend, one crucial characteristic is constantly overlooked: effective communicator. Far too often, problems in relationships arise when one person does not communicate their feelings adequately, withholds information, or is not open with the other person. Even though these may appear to be three seemingly different scenarios, they all deal with communication. Effective communication is key to a successful relationship, and ensures longevity and happiness in the future.

Since all relationships are built on trust and mutuality, being able to communicate effectively with your partner is imperative. While you may be in constant communication with your boyfriend or girlfriend throughout the day via text messages, phone calls, or Skype sessions, what you say to one another is important. Whether something is bothering you within the relationship or you have something significant to tell your partner, you should feel comfortable enough to share. If you feel as though you cannot express your feelings or open up, it may be time to reevaluate your relationship. Being able to be honest with one another is central to the success of your relationship, and will only make it stronger.

Even though this may seem clich?, your significant other really does double as your best friend. At the end of the day, he or she is the one you share everything with ? what?s happening in your life, your personal feelings and struggles, etc. ? and you rely heavily on him or her for emotional support. Being able to talk about these sorts of things is crucial to your relationship, and will only deepen your connection with one another. And the more you work to strengthen your communication, the better your relationship will be.

If you feel as though communication between you and your significant other could be stronger, now is the time for change. Do not be afraid to sit down and talk about how you two can communicate more effectively, because in the long run, you are only bettering your relationship and building on a stronger foundation. And as time goes on, you will be able to look back and see how far you two have come.

Former state legislator and Land Board at odds over what constitutes "land" under the Idaho Constitution.

?Every business owner and would-be business owner in Idaho needs to be made aware,? says a former state legislator. ?Our government is on its way to becoming the largest real estate agent in the state.?

The warning comes from Bob Forrey, a former member of the Idaho House of Representatives in the mid-1980s. Forrey has assumed a ?watchdog? role in recent years with respect to the Idaho Department of Lands (IDOL), and he?s especially concerned now.

?The Land Board has a plan in place,? Forrey recently told IdahoReporter.com. ?They call it the Asset Management Plan, and it?s a plan for the board to buy up more commercial businesses.?

Indeed, the department does have such a plan, and it has been in place since December of 2011 (it can be viewed here).? However, Emily Callihan, spokesperson for IDOL, rejects the ?plan to buy up commercial businesses? description.

?A better characterization would be to say that by approving the Asset Management Plan, the Land Board provided direction regarding the need to diversify the land assets,? Callihan told IdahoReporter.com.

According to her, this quest for a more diverse portfolio includes? the pursuit of ?more leasing activities such as office-retail, commercial energy resources, commercial recreation, communication sites, industrial facilities, and many other types of leasing scenarios that fit under the ?commercial real estate? asset classification.?

But even before devising its Asset Management Plan, the Idaho Land Board has been criticized for investing in commercial property and thereby competing directly with private for-profit enterprise. Members of the board argue that the Idaho Constitution requires that public lands must be managed ?in such manner as will secure the maximum long term financial return to the institution to which granted,? and this is said to imply a ?fiduciary responsibility? for the board members.

But Forrey believes that the language in the Idaho Constitution regarding the management of public lands is being interpreted inappropriately. ?It says ?land.? The constitutional language makes no reference to the government acquiring buildings or private businesses. It only makes reference to land, and even at that, the language references land that was acquired from the federal government at the time of statehood, and land that might be acquired from the federal government in the future.?

For this reason, Forrey is proposing that businesses that have been purchased by the Idaho Land Board be sold.

The former state representative is not alone in his concerns. When the Land Board acquired a commercial building in downtown Boise earlier this year and then leased the building to 10 Barrel Brewing Company, an Oregon company, Rep. Erik Simpson, R-Idaho Falls, told IdahoReporter.com that ?we need to be very careful with what we deem to be within the so-called ?fiduciary responsibilities? of the state. There are good intentions involved with their (the Land Board?s) current approach, but if we?re not careful we can end up doing what President Obama has done with General Motors.?

State Rep. Grant Burgoyne, D-Boise, expressed similar concerns regarding the Land Board?s acquisition in 2010 of the Affordable Storage business in Boise. ?The Land Board seems to have adopted a policy of injecting itself into the private sector,? Burgoyne told IdahoReporter.com in October of this year. ?They have now come down to the point of trying to dictate to those in charge of the operations of the Affordable Storage business, even to the point of dictating who is and who is not employed there.?

But Forrey is also championing legislation that would require the Land Board to open up competitive auctions for state-owned land that is to be leased. He believes his approach is consistent with a recent decision at the Idaho Supreme Court, when in June of this year the court struck down a law that shielded state-owned cabins from competitive bidding.

?There is no limit to what this current Land Board will try to acquire and own, and they need to be reined-in,? Forrey says. ?I once asked Secretary of State Ben Ysursa (a member of the Land Board) if he thought it would be appropriate for the Land Board to buy Albertsons. He told me ?yes, if we had the money, I?d want the board to buy Albertsons.?? This is very destructive to our economy, and our private sector, and it needs to be stopped.?

When asked by IdahoReporter.com if there are any limits on the types of businesses that the Land Board would try to acquire, IDOL spokesperson Callihan replied that ?the department is not in a position to state what types of commercial properties this board or a future Land Board would not consider acquiring.?

Professional Reflections: A Service Delivery Issue I feel Strongly About

An issue I feel strongly about is using scores from standardized tests to determine (assess) an individual?s speech and language abilities. I learned about what validity and reliability mean in reference to using standardized testing tools early in my educational course work for this field. What is bothersome to me is that while it is common knowledge that most if not all exams, especially those for children, are not ?normed? on children I would test, many agencies and supervisors demand a score as part of an evaluation report.

Children I would test are those that live in New York City and the New York region (i.e., Long Island, Yonkers, Westchester). Further exasperating this topic are those children which are exposed to more than one language. These children do not follow the ?typical? speech and language developmental norms of any monolingual community. Therefore, why are SLPs using these testing tools to make an assessment? Some may think the SLP is monolingual and may not be aware. Let?s make it clear, there is no SLP that should graduate from any program, bilingual or not, that is not aware of reading a testing manual at the least. We are also taught, even if briefly, that testing tools should be scanned to remove or adjust bias questions/materials and that bilingual children should be tested by bilingual SLPs. Let me make another point clear: while a person is bilingual it does not qualify them to assess a bilingual person. For example, I am proficiently bilingual in English and Spanish. ??

What is especially worrisome is that while this is such a touchy subject, a certified SLP can actually lose their license over this issue/topic (using a score to report findings). I would venture and guess that one or two malefactions would not substantiate a license being revoked, however it baffles me as to how not more of an emphasis is made on using appropriate testing materials and informed clinical opinions to report findings instead of using scores from a test. In New York City there are rarely any children that would meet the reliability, validity, and norming standards for any test that I know of, yet I find that too often they are used to assess the child?s language abilities.

Catherine J. Crowley is not only the director of the Bilingual Institute at Teachers College, Columbia University but she is an advocate for this issue. In reality, I cannot say she is an advocate she is the leader who identifies what issues need to change and how to go about changing them. Last year when I started at the institute she informed us of some upcoming trainings and reforms regarding this precise topic: agencies forcing their employees to use scores to report a disorder/delay. Cate, as she likes to be addressed by her students, is still conducting trainings around the city to various agencies and changing policies as we speak. She has a lot of support, some of which is through her students and staff. Cate posts information on the institution?s Facebook page such as rallies, petitions, current events, etc. This is a person that I would reach out to about this issue and support for continuing to proctor this change.?

Devices in Google?s Nexus line will soon be?receiving?a small update to fix some of the bugs with the earlier release.

With the release of Android 4.2 there was a bug that removed the month of December from the People app. Trying to enter a birthday or anniversary in December from within the app would skip straight from November to January. Also, there was an issue with Bluetooth connectivity. When streaming music from a handset running 4.2 (Jelly Bean) to a?Bluetooth?device, it would often stutter and fail to play music.

Graphene/nanotube hybrid makes single-surface material for energy storage, electronics

ScienceDaily (Nov. 27, 2012) ? A seamless graphene/nanotube hybrid created at Rice University may be the best electrode interface material possible for many energy storage and electronics applications.

Led by Rice chemist James Tour, researchers have successfully grown forests of carbon nanotubes that rise quickly from sheets of graphene to astounding lengths of up to 120 microns, according to a paper published November 27 by Nature Communications. A house on an average plot with the same aspect ratio would rise into space.

That translates into a massive amount of surface area, the key factor in making things like energy-storing supercapacitors.

The Rice hybrid combines two-dimensional graphene, which is a sheet of carbon one atom thick, and nanotubes into a seamless three-dimensional structure. The bonds between them are covalent, which means adjacent carbon atoms share electrons in a highly stable configuration. The nanotubes aren't merely sitting on the graphene sheet; they become a part of it.

"Many people have tried to attach nanotubes to a metal electrode and it's never gone very well because they get a little electronic barrier right at the interface," Tour said. "By growing graphene on metal (in this case copper) and then growing nanotubes from the graphene, the electrical contact between the nanotubes and the metal electrode is ohmic. That means electrons see no difference, because it's all one seamless material.

"This gives us, effectively, a very high surface area of more than 2,000 square meters per gram of material. It's a huge number," said Tour, Rice's T.T. and W.F. Chao Chair in Chemistry as well as a professor of mechanical engineering and materials science and of computer science and a co-author with former postdoctoral researcher and lead author Yu Zhu, now an assistant professor at the University of Akron.

Tour said proof of the material's hybrid nature lies in the seven-membered rings at the transition from graphene to nanotube, a structure predicted by theory for such a material and now confirmed through electron microscope images with subnanometer resolution.

Carbon has no peer as a conductive material in such a thin and robust form, especially in the form of graphene or certain types of nanotubes. Combining the two appears to offer great potential for electronic components like fast supercapacitors that, because of the massive surface area, may hold a great deal of energy in a tiny package.

Rice chemist Robert Hauge and his team made the first steps toward such a hybrid over the past decade. Hauge, a distinguished faculty fellow in chemistry at Rice and co-author of the new work, discovered a way to make densely packed carpets of nanotubes on a carbon substrate by suspending catalyst-laced flakes in a furnace. When heated, the catalyst built carbon nanotubes like skyscrapers, starting at the substrate and working their way up. In the process, they lifted the aluminum oxide buffer into the air. The whole thing looked like a kite with many strings and was dubbed an odako, like the giant Japanese kites.

In the new work, the team grew a specialized odako that retained the iron catalyst and aluminum oxide buffer but put them on top of a layer of graphene grown separately on a copper substrate. The copper stayed to serve as an excellent current collector for the three-dimensional hybrids that were grown within minutes to controllable lengths of up to 120 microns.

Electron microscope images showed the one-, two- and three-walled nanotubes firmly embedded in the graphene, and electrical testing showed no resistance to the flow of current at the junction.

"The performance we see in this study is as good as the best carbon-based supercapacitors that have ever been made," Tour said. "We're not really a supercapacitor lab, and still we were able to match the performance because of the quality of the electrode. It's really remarkable, and it all harkens back to that unique interface."

English Honors for Grade 7 : ISM Grade Six

    Dear Current Grade 6 Parents,

An English Honors Program is offered in Grade 7 in the Middle School. This program offers opportunities for students who want to enrich their English experience with literature and improve their reading, writing, listening and speaking skills. The published aims and objectives of the English Honors Program at ISM are:

To broaden and deepen student appreciation of literature by engaging in a study of challenging literary texts
To foster a greater sense of the artistry and artfulness of language and writing
To extend each student?s English skills beyond the regular English curriculum
To foster a deeper understanding of how communication skills enrich and enhance the learning experience across the curriculum

The Honors Program: What is it and why do we do it?

The English Honors Program is primarily about enrichment; it is not used as a prerequisite for future English courses such as the IB Program in the High School. The Middle School English Honors Program, however, is good preparation if a student wants to pursue English studies in the future.

While the English Honors Program focuses upon enrichment, it is not for everyone. Parents should talk to their child about the challenges of the class. You need to be honest and think deeply about your reasons to apply. Does your son or daughter fit the profile of an Honors student? Before you consider applying, look at the following criteria of what makes an ideal Honors student:

Honors profile: What does an Honors student look like?

Students in our Honors Program see the communication skills of reading, writing, speaking, and listening as essential components to their lives both in and out of an English classroom.
They consistently demonstrate mastery of the skills taught in English and therefore function more independently as English learners.
They achieve and maintain the highest standards of English at ISM as reflected by their English grades at ISM and in external testing.
They want to extend and deepen their English skills beyond the regular English curriculum.
They want greater formal exposure to challenging and varied literature.
They are avid readers and writers who practice these skills beyond required coursework.

How does my son or daughter apply for Honors?

If students presently in Grade 6 want to be considered for Honors in the next school year, they must first meet the minimum requirement of a first semester grade of A- to apply. If they have achieved this cutoff grade, they can then submit the slip at the end of this letter as an application of interest. This will allow each student to be assessed in the four areas of consideration:

First semester English grade: The minimum requirement is an A- in English.
Teacher Recommendation: Teachers will look at each student?s educational dispositions to determine whether they are reflective, self-directed critical thinkers and creative problem solvers.
External assessment scores: The first semester?s MAP scores for language and reading will be considered as another piece of data.
Cornerstone Writing Assessment: The Honors exam has been replaced this year with our second semester cornerstone writing assessment. All middle school students will participate in this writing assessment, and the results will be used to inform English instruction throughout the school; however, the results of this assessment will also be the final piece in determining our honors students for next year. The cornerstone will examine each student?s ideas through comprehension, analysis/interpretation, and evaluation as well as technical writing ability as described by voice, word choice, and sentence fluency. No preparation is possible or needed for the cornerstone assessment as all students will complete it.

A teacher panel will conduct a careful review of the information outlined in the four areas for each potential Honors student. After reviewing the criteria, the panel will select the top candidates for grade 6 to be offered a place in the English Honors class for next year.

    Timeline:
    Dates Actions
January Cornerstone Writing Assessment will be held
February 1 Deadline for Expression of Interest slip- turned into English teacher

(School must receive this slip for a student to be considered for Honors, including both parent and student signatures)
March Student applications considered and Honors lists decided
April Letters sent to parents on Honors decisions

What is my first step to apply for English Honors?

If you have read the requirements for the Honors Program, know that your son or daughter has met the minimum grade requirement and feel that he or she is a potential candidate, then please fill in and send back the intent slip at the bottom of this letter by February 1, 2013. This slip expresses your interest; you must hand this in if your child is to be considered for the program.

If you have any questions, please do not hesitate to contact me directly at burked@ismanila.org.

    Sincerely,

    David Burke Simon Gillespie

Health and environmental risk in flame retardants in building insulation

ScienceDaily (Nov. 23, 2012) ? Researchers in the United States are calling for a change to the US building codes, following a study showing that the mandatory flame retardants routinely added to foam insulation are not only harmful to human health and the environment, but also make no difference to the prevention of fire in buildings where a fire-safe thermal barrier already exists. Such a change would bring the US building codes in line with regulations in Sweden and Norway.

The research team, which is drawn from US-based centres of excellence including the University of California and the Lawrence Berkeley National Laboratory, conducted a thorough review of fire safety literature since the mid-1970s and conclude that the addition of halogenated organic compounds to plastic insulation materials such as polystyrene, polyisocyanurate and polyurethane is costly, ineffective and environmentally damaging. Their conclusions are published in the latest issue of the journal Building Research and Information.

Led by internationally renowned fire expert Dr Vytenis Babrauskas of Fire Science & Technology Inc., the research team investigated the impact of the "Steiner Tunnel test," which is used to test the propagation of fire over the surface of all sorts of building materials in the early stages of fire (before flashover point is reached). Their paper suggests that changing the US building codes to exempt foam plastic insulation materials from the test would avoid the use of thousands of tonnes of flame retardants that are known or suspected to be persistent organic pollutants. They conclude:

"Such a change would ? decrease the cost of foam plastic insulation and encourage the use of insulation materials for increasing building energy efficiency and mitigating climate change. The potential for health and ecological harm from the use of flame retardant chemicals would be reduced and the fire safety of buildings would be maintained.

The Steiner Tunnel test, showing the flame being applied to the ceiling, is an inadequate and inappropriate method for testing insulation safety. Photo: IntertekTesting Services Inc.

Their article begins with a review of the development of the US building codes in relation to fire safety, and foam insulation in particular, and explains that foam plastics used for insulation have required a thermal barrier (usually 12.7 mm (1/2 inch) thick gypsum wallboard) since 1976. In addition, chemicals such as hexabromocyclododecane (HBCD) and Tris (1-chloro-2-propyl) phosphate (TCPP) are routinely added in order to meet the requirements of the Steiner Tunnel test. The building codes have never stipulated that chemicals be added to foam plastic insulation, however doing so is the most common way to meet the Steiner test. These additives are semi-volatile organic compounds (SVOCs) which do not bind to the insulation material and are known to be released into the environment throughout the life cycle of insulation. The chemicals can persist and accumulate, and have been implicated in thyroid hormone disruption and nervous system development problems and are potentially carcinogenic.

The experts suggest that exempting foam plastic insulation materials from the Steiner Tunnel test would mean there was no longer a need to add these flame retardants.

As well as presenting a detailed analysis of the problems associated with the Steiner Tunnel test, the article reviews the:

? Adequacy of the thermal barrier

? Fire propagation into a cavity constructed in violation of codes

? Behaviour of exposed foam insulation installed in violation of codes.

The article also discusses alternative courses of action, including the possible development of a more accurate test, the use of different flame retardant chemicals and a range of options for mitigating the impact of the flame retardants currently used.

Finally, the article says that such an action would not be without precedent. Flame retardants were once routinely added to children's pajamas, but their use was discontinued in many regions after a range of adverse environmental and health impacts were identified. Dr Babrauskas and his team conclude that, in the light of their evidence, an equivalent volte-face should be implemented in the US building codes as soon as possible. They also recommend a root and branch review of the process of designing fire standards and building codes, in particular to ensure that fire scientists, building code officials and other regulators consider the efficacy, life cycle, health and ecological impacts of building materials.
